AVES & ATLAS — TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Aves & Atlas website, online store, products, and related services (collectively, the “Services”).
By accessing the Services or placing an order, you agree to these Terms and to the policies referenced on our store, including our Privacy Policy and Refund Policy. If you do not agree, do not use the Services.
1. ABOUT OUR STORE
Aves & Atlas operates an online apparel store. Our ecommerce storefront is hosted by Shopify, which provides technology used to operate the store and process transactions.
2. ELIGIBILITY AND ACCOUNTS
You may use the Services only if you are legally able to enter into the transaction or are using the Services with any authorization required by applicable law.
If you create an account, you are responsible for providing accurate information and for maintaining the confidentiality and security of your account credentials.
3. PRODUCTS AND PRODUCT INFORMATION
We try to describe and display our products as accurately as reasonably possible. However:
- colours may appear differently depending on your screen or device;
- product mockups and photographs may not perfectly represent every physical detail;
- placement, colour, and appearance of printed artwork may have minor production variations; and
- product descriptions, pricing, availability, and specifications may be updated without notice.
Nothing in this section limits any rights that cannot legally be excluded.
4. ORDERS
When you submit an order, you are offering to purchase the products in your cart.
We may accept, reject, limit, or cancel an order where reasonably necessary, including because of payment problems, suspected fraud, product or fulfillment errors, pricing errors, technical issues, or product unavailability.
If we cancel an order after payment has been collected, we will arrange any refund that is legally or contractually required.
You are responsible for reviewing your order details before checkout, including product, size, colour, quantity, email address, and shipping address.
5. PRICES, TAXES, AND PAYMENT
Prices are shown in the currency displayed on the store at the time of purchase. Applicable taxes, shipping charges, duties, customs charges, or other fees may be added where required or disclosed at checkout.
You agree to provide current, complete, and accurate payment and billing information and represent that you are authorized to use the payment method submitted.
We may correct obvious pricing or listing errors. If an error affects an order you already placed, we may contact you regarding the available options.
6. SHIPPING AND DELIVERY
Shipping and delivery times are estimates unless expressly stated otherwise.
Delivery can be affected by production schedules, carrier operations, customs, weather, address issues, or other circumstances outside our reasonable control.
You are responsible for entering a complete and accurate shipping address. If you notice an error after placing an order, contact support@interesta.ai as soon as possible. We cannot guarantee that an address can be changed once production or fulfillment has started.
7. FINAL SALE, REFUNDS, AND ORDER ISSUES
All ordinary purchases are final sale once an order has been placed. We do not offer voluntary returns, refunds, or exchanges for change of mind or customer ordering errors such as the wrong size, colour, product, or quantity.
Damaged, defective, misprinted, or incorrect orders are reviewed case-by-case. Please see our Refund Policy for full details.
Nothing in these Terms or our Refund Policy limits any mandatory consumer rights or remedies that cannot legally be waived.
8. INTELLECTUAL PROPERTY
The Services and their content, including our branding, logos, artwork, illustrations, graphics, photographs, text, layouts, product designs, and other materials, are owned by or licensed to Aves & Atlas and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial shopping purposes.
Unless we give written permission, you may not copy, reproduce, distribute, sell, license, modify, create derivative works from, publicly display, or commercially exploit our protected content.
Third-party names, trademarks, and services remain the property of their respective owners.
9. ACCEPTABLE USE
You agree not to use the Services:
- for unlawful, fraudulent, or abusive purposes;
- to infringe the rights of Aves & Atlas or another person;
- to introduce malicious code or interfere with the operation or security of the Services;
- to attempt unauthorized access to accounts, systems, or data;
- to scrape, harvest, or collect personal information in violation of applicable law;
- to impersonate another person or misrepresent your identity; or
- in any way that materially disrupts or damages the Services.
We may restrict or terminate access where reasonably necessary to protect the store, customers, third parties, or our legal rights.
10. THIRD-PARTY SERVICES AND LINKS
The Services may depend on or link to third-party services, including Shopify, payment providers, fulfillment providers, shipping carriers, analytics providers, or other websites.
We are not responsible for third-party websites or services that we do not control. Your use of those services may also be subject to their own terms and privacy policies.
11. PRIVACY
Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy.
Because the store is hosted by Shopify and supported by other service providers, information may be processed by those providers as necessary to operate the Services.
12. DISCLAIMER
To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, or free from every security risk.
We do not exclude, limit, or disclaim any warranty, condition, right, or remedy that applicable law does not permit us to exclude, limit, or disclaim.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Aves & Atlas will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from or related to the use of the Services or products.
Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms limits liability where doing so would be prohibited by law.
14. INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another party's rights.
15. CHANGES TO THE SERVICES OR TERMS
We may update the Services and these Terms from time to time. The current version will be posted on our website with an updated revision date.
Changes will apply prospectively except where applicable law permits or requires otherwise.
16. TERMINATION
We may suspend or terminate access to the Services where reasonably necessary, including for a material violation of these Terms, fraud, abuse, security concerns, or unlawful activity.
Provisions that by their nature should survive termination will continue to apply.
17. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.
18. NO WAIVER
If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.
19. GOVERNING LAW
These Terms are governed by the laws applicable in Ontario, Canada, and the federal laws of Canada applicable there, without limiting any mandatory rights you may have under the laws that apply to you as a consumer.
